Congress passed the law appropriating the funds.

There are cases that say the President cannot impound, withold, etc. such funds, without congressional review and approval, which is why the Fed Ct did what it did. It flows from the separation of powers in the USC which gives the appropriations power to congress, not the President.

Of course who the F knows what the Sup Ct will do - the majority sometimes do not give a rat's behind about their own (Sup Ct) precedent...alas.

The key Supreme Court case addressing presidential impoundment of funds is Train v. City of New York (1975). This case established that the President does not have the unilateral authority to impound funds allocated by Congress, even before the Impoundment Control Act of 1974

The Impoundment Control Act of 1974 is a U.S. law that regulates how the President can withhold or delay spending of funds appropriated by Congress. It establishes procedures for the executive branch to propose deferrals (temporary delays) or rescissions (permanent cancellations) of spending, and requires congressional review and approval for such actions. This act was enacted in response to concerns about the President's ability to unilaterally impound funds

If this were any other administration, I’d agree with you. They ignore the courts and the courts don’t hold them accountable. States likely won’t see any money from this in its current form. They will stall until the BBB retroactively kills the funding or FHWA will rewrite the grant eligibility and start over.

The initial blockage of the funds was a just a delay tactic. The final nail will come in the passing of the f’ing Big Beautiful Bill. It has the language to rescind the original funding.

So contact your rep or senator and tell them to vote No! That’s the only hope we have of seeing these funds continue to be available.

If this were any other administration, I’d agree with you. They ignore the courts and the courts don’t hold them accountable. States likely won’t see any money from this in its current form. They will stall until the BBB retroactively kills the funding or FHWA will rewrite the grant eligibility and start over.

Laws are passed for others to follow ... DUH

That's the whole reason for all the noise and churn. Two weeks from now no one (except of the Iranians) will bother to think about the military action against Iran.

I had to chuck when I saw "1974" above because that was the year Nixon resigned ... how far things have come from then!
