Hello, I am new to the forum. Apologies if this is not allowed, but I wanted to share a (possibly) urgent PSA for those who purchased a 2023 Ford Lightning. Especially those who purchased from Ford in Oregon.

Sellers (aka dealers) of vehicles that are eligible for a new clean vehicle credit under IRC 30D must furnish a report to the buyer at the time of sale and then to IRS for those vehicles to be eligible for a credit under IRC 30D.

Information must be submitted “to the IRS by January 15 of the year following the purchase. The first reports are due to the IRS by January 15, 2024.”

Ford is NOT doing this, which did they not disclose to us until this week. This business decision makes our purchase and likely many others from the dealership ineligible for the tax credit.

Edited to add: I went into the dealership today and got my letter. They also thanked me for flagging this. They said no one else asked about it and they weren’t aware, and neither were other local dealerships. They said we saved their customers and likely many others at dealerships that were previously unaware of these requirements for 2023. I am super relieved it worked out for us and everyone who purchased from said dealerships in 2023 and didn’t realize they were gonna be SOL.

I got my 30D when I bought mine last year with the signatures, my vin and showing I was eligible for the full $7,500. I emailed the dealer a few days ago asking if they filed with the IRS as well since the deadline is Jan 15th. They replied saying they are doing it this week. Not sure if they forgot or just planned to do it the first week of the new year. Regardless, it's good to check.

That is perfect, I am glad you don’t have to fight them for it! No one needs the additional stress. ?

I don't think a dealer can choose not to report. Notice the word "must" is used consistently in the IRS instructions,FAQs, and Rev Proc's. I have not looked at the legislation, so I don't know what it looks like in there, but typically when there is a "must" it indicates a requirement. I'm not sure if there is an enforcement mechanism.

Also, if they advertise that their vehicles are eligible for the credit and then are not taking the steps to allow for a credit to be claimed, it sounds like a ripe situation for the customers of that dealership to collectively sue them.

The IRS did not accept time-of-sale reports for 2023 until Jan 1, 2024.

If you took delivery of your qualified BEV between 1/1/2023 & 12/31/2023, then you MUST claim your credit on filing your personal income tax return with the appropriate schedules.

The dealers are required to send in the supporting information outlined in the IRA to IRS by 1/15/2024 regarding 2023 qualified sales. If they refuse to do so, they will have issues, no worries for you.

You might receive an inquiry sometime in the next 3 years to substantiate your claim, keep all your paperwork showing the Lightning is a qualified purchase entitled to the a tax credit

I have a sneaking suspicion they will be rejected for sales running 1/1/2023 to 12/31/2023, if that happens, did you sign anything with the dealer that they retain the right to recover from you the extra credit?

If they ask you for funds, then in good consciousness you could & should make a claim for the credit on your 1040 with appropriate schedules, I hope you have sufficient gross tax liability and are under the maximum AGI limitations.

I agree, I wish I had taken screenshots of their advertisements at the time, but I do have emails and such. I haven’t met others that purchased a EV from the dealership but they’ve got to be out there!

I got mine upfront credit of $7500 as a part of the down payment yesterday at Ourisman Ford.

But my 2023 Lightning Pro - manual tailgate won't open for some unknown reason.

A bit off topic, sorry...

Just brought this truck home yesterday evening.
This morning after unlocking the vehicle, I tried to open the tail gate manually - no go.
Do not even hear any latch movement.
Tried using the lock-unlock on the key FOB, still no luck.
The is no power tailgate on the Pro, but just in case, I looked in the cab for a tailgate open button - nope.
I tried putting more lift pressure on the handle, but nothing - didn't want to break the plastic.

So do I take it in for bumper to bumper warranty repair or open the panel and see what's going on with the latch?
I guess if I do that, and Ford sees any tool marks on the screws, Ford might say it's my fault.
Bummer, not even 1 day old and already.

The salesman is telling me to look for a button to the left of the steering wheel which may unlock it.

Aha! Pressing the unlock button on the driver's door unlocked the tailgate - go figure!
