But then get a a major fail for the simple task of keeping it in the mode I want, sports mode. (Sorry Ford I'm going to bash you on that every time I can until you fix it).
Unfortunately you will have to bash them forever because it is not going to change. There was actually an OTA that fixed this, and then they were forced to reverse it via an actual (I believe NHTSA) recall.

This would pretty much mean that sport mode changes the ESC mapping. I guess maybe to something less aggressive? I wonder what all the changes are. Couldn't they add a 'Default' toggle on the mode screen and become compliant?

I know the story inside and out. NHTSA forced them to reverse the OTA because of off road mode. Sports mode is a perfectly legal and safe mode to drive in should an unsuspecting driver get into the vehicle. If sports mode was the default method, and called normal instead, there would be no issue. Ford was/is lazy and decided to default all modes to normal instead of isolating the issue which is only off-road mode. In fact defaulting tow-mode back to normal when the truck knows a trailer is still attached, too me is even worse than the original problem the NHTSA was bickering about in the first place.
